Definitions

You”, “your” or “yourself” means the person who made the ticket booking & who is bound by these terms & conditions.

We”, “us” or “our” means Wasing Outdoor Events Ltd (Company number 13692241) at The Estate Office, Wasing Park, Aldermaston, RG7 4NB.

Venue” means Middle Lake, the outdoor sauna and the seating area by the firepit.

“Facilities” mean the wild swim facilities located Middle Lake, the outdoor sauna, the shower and bathroom facilities.

Event” means Wasing Wild Swim, Sauna & Firepit Lunch event which takes place at the Venue described above on the dates outlined in the Booking Policy.

Booking” or “Bookings” means the booking of a Ticket or Tickets to Wasing Wild Swim, Sauna & Firepit Lunch event which has been confirmed by Us with a booking confirmation number.

“Ticket” or “Tickets” mean a printed or electronic ticket issued by Us to You from Our ticketing platform.

Force Majeure Event” means an event beyond Our reasonable control including, but not limited to, serious damage to the Venue, strikes, lock-outs or other industrial disputes (whether involving the workforce of the party or any other party), failure or interruption of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, security alert, sickness, pandemic, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or other serious adverse weather condition, theft, burglary or malicious acts of third parties.

Terms & Conditions

1.       A binding contract between You and Us comes into existence when the final page of Our ticketing website provides you with a Booking confirmation number.

2.       Ticket prices The price per Event Ticket for Adults & Children aged 16+ is displayed at https://wasing.digitickets.co.uk. We do not offer Child Under 16 or Concession Tickets. Prices are inclusive of any applicable taxes. All Bookings are subject to a booking fee which will be applied at the time of purchase. Prices are displayed on the website and are subject to change without notice. Once payment has been taken, the price of Your ticket will not change. Ticket price promotions or discounts are for limited timeframes and for a limited number of Tickets only. Such promotions are only valid if issued by Us and are subject to their own terms & conditions.

3.       Booking policy Everyone attending the Event requires a Ticket. All Tickets are subject to availability. Tickets can be purchased online only at https://wasing.digitickets.co.uk/  Please check your Ticket(s) thoroughly before payment as mistakes cannot be rectified. We take no responsibility for any lost or stolen Tickets. Tickets are for personal use only and must not be resold, transferred or exchanged. Tickets must not be distributed for commercial purposes such as corporate events, competitions or Marketing promotions, unless approved by Us in writing in advance. Ticket purchasers must be aged 18 or over and by placing an order with Us, You are confirming that You are aged 18 or over. Tickets are for the Wasing Wild Swim, Sauna & Firepit Lunch event only and do not allow access to any other area of Wasing Estate or any other course, workshop or event taking place anywhere at Wasing Estate.

4.       Admission policy We operate a strict “no ticket, no entry” policy. Please ensure You bring either Your email Booking confirmation or printed Tickets to the Event. We reserve the right to check Tickets upon entry to the Event and reserve the right to refuse entry if a valid Ticket cannot be shown to Event staff. There are no printing facilities at the Event. The Venue is in a rural location and mobile network provision can vary so please ensure You download Your Tickets before arriving. We reserve the right to require proof of age for any individual within Your party and this must be shown upon request. You must comply with instructions by Event staff at all times and follow any health & safety instructions at the Venue.

The Event is subject to a strict timetable and You must arrive at the Venue at the time indicated on Your Booking confirmation. Should you arrive outside of this time, no refunds or compensation will be offered. All Event attendees must vacate the Venue at the advertised event end time.

We reserve the right to refuse entry to You or anyone in Your party if We feel You are compromising the safety of Yourself or others around You. We also reserve the right to refuse entry to You or anyone in Your party if We are concerned that You or a member of Your party may negatively affect the enjoyment of the Event by other   ticketholders and guests, or if you are not treating Our staff, volunteers and contractors with dignity and respect. For the same reasons, We also reserve the right to request that, after admission, You and all members of Your party leave the Venue with immediate effect. Reasons for refusal of entry or a request to leave the Venue include, but are not limited to, foul language, intoxication (alcohol or drugs), unlawful activity, sexual harassment, verbal or physical aggression, ridicule, humiliation, harassment, bullying, intimidation, threatening behaviour and any behaviour that is deemed by Us to be inappropriate, to cause offense or to not be in-keeping with the nature of the Event. We have a zero tolerance policy on all aforementioned actions and behaviours towards Our staff, volunteers, contractors, ticketholders and guests, and anyone behaving in this manner will be refused entry or asked to leave immediately. Should this occur, no refund or compensation will be offered or provided under any circumstance.

5.       Changes by you If You set up an account on the https://wasing.digitickets.co.uk/ ticketing website BEFORE you purchase tickets, You may be able to change the date or time of Your Booking or to add additional Tickets to Your Booking by logging in to Your account. Any amendments are subject to availability and it is not guaranteed that any amendments can be made. If upon logging in to Your account, alternative dates/times or additional tickets are not available, Your Booking cannot be amended. If You do not set up an account on the https://wasing.digitickets.co.uk/  ticketing website BEFORE You purchase tickets, no amendments can be made to Your Booking. Should You be unable to use the tickets You have booked without making an amendment, this constitutes a cancellation and the “Cancellation by You” policy will apply. Whether You are or are not in possession of a DigiTickets account, tickets cannot be removed from Your Booking or cancelled under any circumstance and in this scenario the “Cancellation by You” policy will apply. We may choose to release additional Tickets after the first initial Ticket release. If We do this and a date or time becomes available that was not available at the time that Your Booking was made, We are under no obligation to make any amendments to Your Booking.

6.       Cancellation by You You can cancel up to 8 weeks before the Event date by emailing wellbeing@wasing.co.uk and receive a full refund minus the Booking fee. For cancellations within 8 weeks or less of the Event date, no refunds or any other compensation will be issued for cancellations by You.

7.       Changes & Cancellations by Us From time to time, it may be necessary for Us to change or cancel confirmed bookings and We reserve the right to do so. Should a change or cancellation be required, We will endeavour to tell You as soon as possible. If there is reasonable time, You will have the option to accept the amendment for example to change Your Ticket(s) to a different time or date subject to availability. If not, We will issue a full refund within 10 working days after the date You were due to attend the Event. Refunds will only be issued to the account details used for the original purchase. Additional compensation above and beyond a full refund of Your monies paid will not be offered. We accept no responsibility for any resulting costs You may incur including travel, accommodation or any other related goods or services.

8.       Covid-19 The Event will operate in accordance with UK Government guidelines. Should You or any of Your party be unable to attend the Event due to contracting Covid-19, the “Cancellation by You” policy will apply.

9.       Limitation of liability and Force Majeure Event  

9.1. This clause 7 sets out Our entire financial liability to You and the members of Your party for whom You have made Your Booking, in respect of:

9.1.1. any breach of contract or negligent performance by Us of the Booking and/or payment process;

9.1.2. any breach of contract or negligent performance by Us (or our employees or contractors) connected with Your Booking;

and 9.1.3. any representations, statements or negligent or harmful acts or omissions arising under or in connection with these Terms and Conditions.

9.2. Nothing in these terms limits or excludes Our liability:

9.2.1. for death or personal injury resulting from Our negligence;

or 9.2.2. arising as a result of fraud or fraudulent misrepresentation.

9.3. Subject to clause 9.2, We will not be liable for the death of or injury to any person attending the Venue for Your Booking or for any losses, claims, demands, actions, proceedings, damages, costs or expenses or other liability incurred by You in the exercise of the rights granted by these Terms and Conditions.

9.4. Subject to clauses 9.2 and 9.3, where We have been negligent and/or breached a contractual obligation to You, We will be liable for any loss or damage You suffer as a result, as long as the loss or damage is foreseeable. Loss or damage is foreseeable if it is an obvious consequence of Our negligence or breach of contract, or would have been considered by You and Us to be a likely consequence of it at the time We entered into these Terms and Conditions.

9.5. Subject to clauses 9.2, 9.3 and 9.4, Our total liability in contract, tort (including negligence), breach of statutory duty, misrepresentation restitution or which otherwise arises in any way in connection with Your Booking shall be limited to the ticket fee paid.

9.6. Force Majeure Event:

9.6.1. We will not be liable to You as a result of any delay or failure to perform Our obligations under these Terms and Conditions as a result of a Force Majeure Event.

9.6.2. We shall notify You as soon as is reasonably practical where We know or suspect that We will be unable to host Your Booking on the Date due to a Force Majeure Event, and We will offer You an alternative date for the Booking to be moved to (subject to availability). The selected new date shall be confirmed by the parties in writing, and Your Booking shall be deemed varied to reflect this new date accordingly. No refunds shall be given to You if You fail to agree to an alternative date.

10.   Smoking For health & safety purposes, We operate a strict no smoking policy. This includes e-cigarettes and vaping. Failure to comply with this policy may result in You and all members of Your party being asked to leave the Venue with immediate effect. Should this occur, no refunds or compensation will be offered.

11.   Pets No pets or any animals are allowed to attend the Event, with the exception of guide, hearing or registered assistance dogs. If You are bringing an assistance dog, please email wellbeing@wasing.co.uk at least 10 days in advance to make arrangements. You may be required to show proof of registration with an approved organisation at any time whilst at the Venue.  Anyone leaving animals unsupervised in vehicles at the Venue will be reported to the relevant authorities.

12.   Venue This is an outdoor event which takes place in a woodland area with a lake and sauna. Vehicle parking is nearby but requires a short walk from the vehicle park to the lake. Whilst pathways will be well maintained, You and Your party may encounter areas with naturally occurring hazards such as mud, uneven surfaces and exposed tree roots. Care should be taken when walking through the woodland area. Please ensure appropriate footwear and clothing is worn. The Venue is private property and access to any other area of the Wasing Estate is forbidden.

13.   Vehicle Parking There is a vehicle car park a short distance from the lake. Vehicles are parked at the owner’s risk. We take no responsibility for any damage or loss to vehicles parked at the Venue, nor for any contents left in the vehicle. Caravans, motor homes, lorries and other similar or large vehicles are not permitted.

14.   Health Considerations You use the Facilities at the Venue at your own risk. You must complete & sign a Health Declaration supplied by Us before the Event starts. Failure to do so will constitute a cancellation and the “Cancellation by you” policy will apply. You must be a competent swimmer, be able to handle cold water exposure and not suffer from any injury, medical condition such as a heart condition, disease or illness, or be using prescription drugs which would make your use of the Facilities unsuitable. Should you have an injury, medical condition, disease or illness or be taking any prescription drugs, you should consult your Doctor before booking the Event. Should you develop an injury, medical condition, disease or illness or start taking any prescription drugs between the time of booking and the Event date, you should consult your Doctor before attending the Event. It is your responsibility to tell Us of any medical conditions, injuries, diseases or illnesses you have or may have by confirming in writing to wellbeing@wasing.co.uk We do not offer any medical advice. We test the quality of the lake water monthly to make sure that it is suitable for swimming.  However, you should be aware that open water swimming can increase the risk of illnesses caused by micro-organisms such as norovirus, giardia and cryptosporidium, and whilst the symptoms will generally be mild, there is also a risk of more severe infections caused by micro-organisms such as E.coli.  Therefore, if the quality of the lake water is not suitable for swimming, we will close the lake until this has been rectified.

15.   Pregnancy & Breast Feeding If you are pregnant or breast feeding, you should consult your Doctor before attending the Event to assess its suitability. If you are pregnant or breast feeding, You should consult your Doctor before swimming in the lake. You must not use the Sauna under any circumstances whatsoever if you are pregnant. It is your responsibility to advise Event staff of your pregnancy or if you are breast feeding and to consult your Doctor on all matters related to your pregnancy or breast feeding. We do not offer medical advice whatsoever.

16.   Facilities We reserve the right to vary, add or remove any of the Facilities and to close or withdraw the Facilities for cleaning, decorating, repairs or other maintenance or for reasons beyond our control. We will endeavour to keep to a minimum the disruption to the use of the Facilities. When using the Facilities, you agree to sensible and responsible conduct, in compliance with all notices, instructions and directions as published, displayed or given directly by Us. You must use the designated platform and ladders provided for entrance and exit to the water at Middle Lake.  There is strictly no diving or jumping due to shallow water. Being set in nature, there are limited changing facilities.  There are wooden pegs on the back of the sauna for hanging bags and towels in order to keep exit points clear and users safe. In order to protect the ecosystem of the lake, please remove all chemical products such as sunscreen, oils and moisturiser, before arriving at the Facilities. No floats, inflatables, snorkels, masks, fins, flippers or other sports equipment are permitted.

17.   Sauna You must make yourself aware of the rules-of-use of the sauna and in particular, You should stick to the recommended time of up to 15 minutes at a time, cooling off between rounds, as the sauna can reach temperatures of above 85 degrees C. Please wear appropriate swimwear, sit on a towel and avoid wearing jewellery or swimwear with metal accessories as these can burn.  Metal water bottles should not be taken into the sauna. Avoid touching the glass partition door and use the wooden handle provided. Only use fresh water on the sauna stones and not lake water or any other substances. Water should only be sprinkled lightly on the stones to control the temperature and steam. If you are pregnant, You must not use the sauna.

18.   Children & Babies Children and babies under the age of 16 years old are not permitted to either attend or be present at the Event.

19.   Travel Please check Your route prior to travelling to ensure that You arrive on time. We are not responsible for any delays or problems caused by travel disruptions of any nature.

20.   Attire We will advise suggested clothing & footwear to wear during the Event in the joining instruction emails that will be sent to You before the Event.  All clothing must be family friendly. Whilst you may prefer to be either bare foot or in flip flops at some points during the Event, you must wear appropriate footwear for walking from the vehicle park to the lake.

21.   Personal Property We accept not responsibility for any loss or damage to any personal property brought to the Venue.

22.   Catering A firepit lunch is included within the price of the ticket. Should you have any specific dietary requirements, please confirm by email to wellbeing@wasing.co.uk at least 10 days in advance of the Event. We will make reasonable efforts to accommodate dietary requests, although this is not guaranteed,

23.   Safety & Security It is strictly prohibited to bring into the Venue any weapons, knives, guns, sharp objects, alcohol, illegal substances, legal highs, fireworks, pyrotechnics, sparklers, smoke bombs, confetti canons, air horns, lasers, flares or any other articles which may in any way damage the Venue and/or cause injury to You, other visitors or staff. Anyone in possession of any of these articles will be asked to leave immediately without refund or any compensation and We reserve the right to report You to any relevant authorities. Fires, naked flames and BBQs are strictly forbidden.

24.   Photography & Videography Personal photography and videography is permitted during the Event. We cannot control, and therefore take no responsibility, if You or any member of Your party appear in another visitor’s photos or videos which are published on social media or elsewhere. Photography is not permitted by a professional or commercial photographer even if they have purchased a ticket. Videography or dronography is not permitted by a professional or commercial videographer or dronographer even if they have purchased a ticket.  Professional or commercial photography, videography and dronography which is solicited by a visitor is also not permitted i.e. visitors are not permitted to hire a professional photographer or videographer to photograph or video them during the Event even if all parties have purchased tickets. Personal, professional or commercial drones are not permitted, unless solicited by Us. From time to time, We, or an approved supplier, may wish to take photos, videos or drone footage at the event for Marketing purposes. If You do not wish to appear in this, please advise Us by emailing events@wasing.co.uk before Your visit and make staff aware on the day. From time to time, We may use stock photography and videography for advertising purposes.

25.   Social Media Competitions Any competitions promoted via Our social media channels are subject to separate Terms & Conditions. These, or where to find these, will be displayed on competition related posts. They can also be obtained by emailing events@wasing.co.uk

26.   Copyright & Intellectual Property Unless credited otherwise, the text & images contained in the www.wasing.co.uk or https://wasing.digitickets.co.uk/ websites and on any Wasing social media page are Our property and are protected by copyright & other intellectual property rights. No part of any of these sites can be reproduced by any process without written permission from Us.

27.   Personal Data Your personal data will be managed responsibly and in accordance with Our Privacy Policy.

28.   Complaints We will make every effort to ensure the Event is an enjoyable experience. If however You encounter any problems, please inform a member of staff during the Event who will make reasonable efforts to resolve the issue. If a suitable solution is not found and You wish to take make a complaint, please email wellbeing@wasing.co.uk within 7 days of the occurrence about which you wish to complain. Please include Your Booking reference number, date & time visited,  the nature of the complaint & any relevant photographs.

29.   Amendments to Terms & Conditions We reserve the right to make amendments to Our Terms & Conditions for this Event at any time and without notice. Any changes to these Terms & Conditions apply to Your ticket purchase with immediate effect from the date of publication on Our website.

30.   Severability If it is found by a Court that any of these Terms & Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.

32.   Governing jurisdiction These terms and conditions shall be governed by and construed in accordance with the law of England and Wales, the courts of which shall be courts of competent jurisdiction.
